morning out of Guadalajara, Mexico that a Mexican federal
court has denied Duane Dog Chapmans injunction
request
and has ruled that the star of A&Es Dog the Bounty
Hunter should be extradited...
On February 16, 2007 the Mexican federal court denied Dog and
his posse an injunction request and ruled that they should be
extradited and stand trial for deprivation of liberty. The
charge stems from the 2003 capture of the convicted serial
rapist, Andrew Luster, in Puerto Vallarta. Learn more about the

TV bounty hunter Duane (Dog) Chapman waits for court action on
pending extradition

HONOLULU (AP) - Duane (Dog) Chapman is waiting to hear whether
a Mexican federal court will set him free or order his pending
extradition and criminal case to proceed.
The 53-year-old TV bounty hunter is charged under Mexican law
with "deprivation of liberty" for his June 2003 capture of
fugitive convicted rapist Andrew Luster, the Max Factor heir,
in Puerto Vallarta.
"Inside, I'm dying," Chapman said in an interview with The
Associated Press at his spacious ocean-view home. "On the
outside, I'm a Hawaiian citizen."
His attorney, William Bollard, will present arguments starting
Monday. Chapman will not attend the closed hearing in
Guadalajara.
"We consider this a critical hearing because it could resolve
the matter," Bollard said. "We're putting a lot of eggs in this
basket because if we can cut it off at the path, the (criminal)
trial never takes place."
Chapman was arrested Sept. 14 along with his son and another
associate and is free on $300,000 bail. He has been
aggressively fighting extradition.
"It's been the most nervous week by far in many years," he told
the AP. "In Mexico, you're guilty until proven innocent. It's
not like America. You must prove your innocence. That's their
law. It's nothing bad or good. That's just their law."
Chapman faces up to four years in a Mexican jail if convicted.
"It's very ironic, isn't it?" said his wife, Beth Chapman. "He
may go to jail for catching a rapist. We're in trouble because
we caught America's escaped prisoner."
Chapman's capture of Luster catapulted the Honolulu-based
bounty hunter to fame and led to the A&E reality series "Dog
the Bounty Hunter."
Luster jumped a $1 million bond and disappeared during his
trial in California's Ventura County on charges that he drugged
and raped three women. The disappearance set off a national and
international manhunt by police, FBI and bounty hunters trying
to recoup some of the bond money. Luster is now serving a
124-year prison term.
Chapman said he was never paid for Luster's capture.

To outmanoeuvre Chr?ien, Black removed the impediment?to
peerage by
renouncing his Canadian citizenship.
Now faced with a huge indictment for fraud in the United
States, Black needs to
brace himself for the worst contingency of all ?the possibility
of doing hard
time in a U.S. jail far from his Canadian family, friends, and
lawyers.
How could re-acquiring Canadian citizenship help him?
The answer lies in our federal International Transfer of
Offenders Act which
came into effect in 2004.
Officially, this law is designed to legally implement treaties
which Canada has
entered into relating to the international transfer of persons
convicted of
criminal offences. Canada and the U.S. signed such a treaty in
1977.
One of the purposes of the Act is to contribute to the
rehabilitation of
offenders and their reintegration into the community by
enabling offenders to
serve their sentences in the country of which they are
citizens.?
The charges laid against Black carry decades of potential jail
time.
If convicted, Black would be better off serving the time here
since the
conditions in our jails are generally viewed as being less
harsh than those in
the United States. Secondly, our parole policies are also
considered to be more
generous than those in the U.S.
Finally, if the sentence imposed by the U.S. is longer than the
maximum sentence
provided for in Canadian law for the equivalent offence, Black
would serve only
the shorter sentence.
Only Canadian citizens are eligible for such a transfer. Black
would have to
wait until all the avenues of appeal in the U.S. have been
exhausted.
Then he must obtain the consent of the U.S., and then of
Canada, to the
transfer.
The receiving state, i.e. Canada, would be responsible for his
transportation
and incarceration costs. Once here, the American verdict and
sentence would not
be subject to any appeal or other form of review in Canada.
Right now, it is unclear if Black has actually applied to
regain his Canadian
citizenship and, if so, if he will get it.
One thing is for sure. His one moment of folly must be keeping
him up late at
night.

file an expungement petition. h.r. 1434 directs the court,

and public safety.
the bill would allow an individual to file a petition to
expunge the record of conviction for a non-violent criminal
offense if the petitioner has: (1) never been convicted of
another violent offense; (2) fulfilled all requirements of
the sentence; (3) remained free from drug dependency on or
abuse of alcohol or drugs for at least one year and has met
any rehabilitation requirements of supervised release; (4)
obtained a high school diploma or completed a high school
equivalency program; and (5) completed at least one year of
community service.

* * * * OTTAWA ?Maher Arar finally received his long-awaited
apology from the prime minister today, accompanied by $10.5
million in compensation for Canadas role in the "terrible
ordeal" of being deported to torture after authorities falsely
labelled him and his wife as terrorists.
"On behalf of the government of Canada, I wish to apologize to
you, Monia Mazigh and your family for any role Canadian
officials may have play in the terrible ordeal that all of your
experienced in 2002-2003," Stephen Harper said in a public
statement to Arar.
"I sincerely hope these words and actions will assist you and
your family in an effort to begin a new and hopeful chapter in
your lives."
Arar said that the apology and compensation will help him begin
to rebuild his life.
"The government of Canada and the prime minister have
acknowledged my innocence," the 36-year-old software engineer
calmly told a news conference.
"This means the world to me."
He thanked his wife for the "courage and strength she has shown
all along" and the Canadian public for standing behind him.
"Without the support of the Canadian people, I may never have
come home and I may never have been able to stay strong and
push for the truth," he said.
Harper said that the government will also pay Arars legal fee,
which are about $1 million. The compensation is the highest
amount Ottawa has ever paid out to an individual.
"I appreciate the fact that for many Canadians this a large
amount of money," Harper told a news conference on Parliament
Hill. "All I can say is ... that is our assessment of the
amount that Mr. Arar would win in a lawsuit."
Arars lawyer, Julian Falconer, said the governments package was
"nothing less than a triumph of innocence."
To those who would say that the compensation is too rich,
Falconer said he did not believe anyone would trade places with
Arar, considering all that he went through.
Arar was arrested in New York in 2002 during an airport
stopover on his way home to Ottawa.
He was deported to Syria and spent a year in jail before he was
released without charges.
Arar, who says he was tortured during the year he was jailed in
Damascus and confined to a grave-like cell, filed a lawsuit in
2004 seeking $400 million, but he reduced his claim to $37
million in December.
Arars ordeal prompted a public inquiry and a final report last
fall placed the bulk of blame on the RCMP for sharing false
intelligence information with American authorities that Arar
was an "Islamic extremist."
Former RCMP commissioner Giuliano Zaccardelli resigned over the
case in December.
Arar remains on a U.S. border watch list, despite Canadas
request to remove his name after the public inquiry removed him
of "any taint or suspicion."
Earlier this month, the Bush administration wrote Canadian
officials saying that its decision to bar Arar from the U.S.
remains "supported by a recent re-examination of the case.
The affair has strained Canada-U.S. relations and Harper
refused today to back down.
"We think the evidence is clear that Mr. Arar has been treated
unjustly. He should not be on a watch list," Harper told
reporters. "I personally believe if there was evidence
suggesting that any of these suspicions against Mr. Arar were
justified, that case would have been made a long time before
today."
He added that the federal government, as well as formally
objecting to the United States over its treatment of Arar, has
also lodged a complaint with Syria.
Arar moved from Ottawa to Kamloops. B.C., with his wife and
their two small children last summer. He said publicly last
fall that he still suffers from anxiety, nightmares and
flashbacks.
The settlement comes as a result of mediation talks between
lawyers for Arar and the federal government. In his lawsuit
against the federal government, Arar alleged negligence,
negligent investigation, defamation, false imprisonment,
assault and battery and abuse of public office. This week, the
issued heated up and threatened to cause a rift in Canada-U.S.
relations.
Last February, a U.S. federal judge threw out a lawsuit by
Arar, which took the government to task over the shady practice
of "extraordinary rendition," whereby terrorism suspects are
sent to regimes with spotty human-rights records for
interrogation.
Justice Dennis OConnor, in his report, recommended compensation
and an apology to Arar, which he said "should recognize the
suffering that Mr. Arar has experienced, even since his return
to Canada."

New airport security screening measure involves nudity
As a way of avoiding having to pat-down and frisk passengers
passing through airport security, officials in Phoenix, Arizona
are testing a new screening technique that generates
effectively nude photos of passengers. The technique involves a
low-radiation X-ray machine that penetrates clothing but not
flesh.
Sleep doctor studies jet lag, offers tips for travellers
Sleep doctor Chris Idzikowski who works for British Airways has
just completed a major survey on jet lag. The study looked at
the effects of jet lag on over 1,000 business travellers and
uses this research to offer tips on managing jet lag, including
the development of an online calculator that tells travellers
the best and worst times to schedule business meetings after a
long flight.

Troy Davis was sentenced to death for the murder of Police Officer Mark Allen McPhail in Georgia. The case against him consisted entirely of witness testimony which contained inconsistencies even at the time of the trial. Since then, all but two of the state's nine non-police witnesses from the trial have recanted their testimony. Many of these witnesses have stated in sworn affidavits that they were pressured or coerced by police into testifying or signing statements against Troy Davis.

Presumption of reasonableness does not bind sentencing judges'
discretion
WASHINGTON, D.C.: Families Against Mandatory Minimums (FAMM)
greets todays U.S. Supreme Court's decision in Rita v. United
States with cautious optimism. While the decision permits
appellate courts to apply a presumption of reasonableness when
reviewing within-guideline sentences, sentencing judges are not
bound by the presumption and will be able to exercise judicial
discretion under the advisory sentencing guidelines. The vote
was 8-1, with only Justice David H. Souter dissenting.
Mary Price, vice president and general counsel of FAMM said,
"There is much in the opinion that will give heart to our
members. Rita is saying hands-off to appeals courts whose
opinions threatened to reinstate mandatory sentencing. This
case came before the Court after many U.S. Courts of Appeals
failed to abide by the lessons of United States v. Booker.
Booker transformed mandatory federal sentencing guidelines into
advisory guidelines. Instead, many appeals courts enforced a
presumption of guideline reasonableness on lower courts."
"The presumption of reasonableness imposed by many courts of
appeals assumed that a sentence within the guidelines was the
reasonable sentence and that a sentence outside the guidelines
was not. This presumption was in turn imposed on sentencing
judges, who frequently saw their below-guideline sentences
overturned on appeal because they violated the presumption of
reasonableness," said Price. In this way, sentencing courts
were actively discouraged from individualizing sentencing.
In Rita, the Court affirmed that judges may apply the guideline
sentence if it is appropriate, based on the individual factors
in the case, but are not required to impose the guideline
sentence based on an appellate court's presumption of guideline
reasonableness. Instead, the Court ruled, sentencing judges
must follow the law of sentencing. That law directs sentencing
judges to impose sentences that are sufficient to serve the
interests of society, but never greater than necessary to
punish it's wrongdoers. Sometimes the guideline sentence will
satisfy that mandate; often it does not.
Said Price, "FAMM's files are filled with stories of defendants
sentenced to unjustly long guideline sentences by judges who
felt compelled to abide by the guidelines, but who also stated
on the record that the guideline sentence they were forced to
impose was unjust in light of the facts and circumstances of
the case. The Rita opinion means that sentencing judges like
them are not bound by any presumption that the guideline
sentence is reasonable or mandatory. "
Much remains to be seen as the lower courts sentence and the
appeals courts review them, and FAMM awaits the Courts decision
in the next case to address the issue, United States v. Gall.
There the court will determine how the presumption of
reasonableness affects sentences that fall below the guideline
sentence. FAMM will participate in the Gall case with an amicus
brief this summer.
"While the Court reserved until next year the issue of how
below-guideline sentences are to be handled, todays decision
should give sentencing courts the ability to reject a guideline
sentence when it is not appropriate in a given case without
fear that the sentence will be reversed by an appeals court
applying a mechanical presumption of reasonableness," said
Price.

Please prevent Elijah Page from becoming the first person to be
executed in South Dakota since 1947.
Elijah was 18 years old when he and two co-defendants were
charged with the murder of Chester Allan Poage. One
co-defendant was tried by a jury and sentenced to life in
prison. But Elijah and the other co-defendant waived their
right to a trial and were given a death sentence.
When sentencing Elijah Page to death, the judge acknowledged
Elijah's childhood of deprivation and abuse, saying "your early
years must have been a living hell." From early childhood
Elijah lived in abandoned houses with his mother who would
allow people to sexually molest him in exchange for drugs.
Now at 25, Mr. Page is scheduled to die by lethal injection on
July 9. He is the 5th inmate this year to waive his appeals or
"volunteer" for execution.
Send a strong message to Governor Rounds that he has the power
to prevent South Dakota from taking a major step backwards by
stopping this unjust execution.

Napolitano gets illegal-hiring bill
Giving jobs to the undocumented yields harsh penalties under
plan

Phoenix -- The Legislature on Wednesday passed a comprehensive
plan that would put firms that repeatedly and knowingly hire
illegal immigrants out of business in Arizona.
The bill says a single violation could suspend a company's
state licenses for up to 10 days. But House Bill 2779 also
would let judges waive that penalty based on factors ranging
from the number of illegal workers employed to the duration of
employment.
Companies also would be able to present evidence that their
directors or officers were not involved in the hiring. But a
second violation within three years would mean permanent
revocation of state licenses.
The legislation also says those who commit intentional
violations — defined by Rep. Russell Pearce, R-Mesa, as
recruiting illegal entrants for jobs — definitely would
be put out of business for at least 10 days for a first
offense. And the probationary period would last five years.
Lawmakers sent the bill to the governor on a House vote of
47-11, and a 20-4 tally in the Senate.
Gov. Janet Napolitano said Wednesday that she had not seen the
final version of the bill. But Napolitano, who last year vetoed
an employer-sanctions bill that she said was too weak,
indicated a willingness to sign this measure.
'I have been saying for a long time you cannot deal with the
border simply by talking about troops and fences and so forth,'
the governor said.
'You have to deal with the underlying labor issues,' she
continued. 'And you have to have a law that can be enforced on
those who intentionally go around the law to hire labor
illegally.'
If Napolitano does sign it, Pearce, who has been the driving
force behind the legislation, said he will recommend that
allies scrap plans to ask voters to approve a more punitive
initiative. That measure would put a firm out of business for
just one knowing violation of the law.
Not everyone was enthusiastic about the legislation.
Sen. Barbara Leff, R-Paradise Valley, worried that a 'rogue'
employee in charge of hiring, acting without blessing of the
business's owners, could put a large company out of business by
hiring one or two janitors who are in the country illegally.
'So we now have 1,200 people who will lose their jobs —
1,198 of them who are American citizens,' said Leff, who chairs
the Senate Committee on Commerce and Economic Development.
'What do we tell those people who have all lost their jobs?'
But Pearce, who has been the driving force behind the
legislation, said that can happen only on a second offense
— and only after a judge found the firm knowingly or
intentionally broke the law.
Rep. Steve Gallardo, D-Phoenix, also objected to the mandatory
revocation for a second offense. He noted that judges would
have no discretion to consider other factors.
But Pearce said the legislation makes it easy for employers to
obey the law.
It specifically requires companies to check the legal status of
new employees through the Basic Pilot Program — now
formally known as the Employment Eligibility Verification
Program — a database run by U.S. Citizenship and
Immigration Services.
And it says any company that uses the program is entitled to a
'rebuttable presumption' that it has not hired undocumented
workers — essentially a legal defense against being found
guilty unless a prosecutor can show the employer really didn't
do the checks, or do them properly.
Most business groups oppose the legislation — with one
major exception: The East Valley Chamber of Commerce Alliance
supports the bill as a preferable alternative to the
initiative. But Jessica Pacheco, lobbyist for the Arizona
Chamber of Commerce and Industry, said state legislators should
instead let Congress enact an immigration measure.

For the first time, Toronto will be working with the province
and Ottawa to make decisions on the way immigrants and
newcomers are treated in this city, World Refugee Day
celebrants heard yesterday.
Mayor David Miller said he's signed an agreement to be at the
decision table with two levels of governments in dealing with
the resettlement of newcomers since more than 60% of all
immigrants end up here.
'For the first time the city can have its say on immigration
and refugee matters,' Miller told several hundred immigrants
and refugee supporters at the Yonge-Dundas Square. 'We fought
for Toronto to have a role to play in important refugee
issues.'
Quebec is the only other jurisdiction to have a say in the way
immigrants are picked and resettled.
'Many residents of the city are living proof of the
contributions immigrants have made to this city,' Miller said.
Canadian Idol judge Farley Flex was the MC of the refugee day
show, which that featured African, Hispanic and Caribbean
bands, many with performers who were former refugees.
Jahanshah Assadi, of the United Nations High Commission for
Refugees, said the war in Iraq has led to an increase in the
number of refugees worldwide from 8.4 million in 2005 to 10
million last year.
'We must keep the asylum door open,' Assadi said.
Iraqi businessman Aziz Sepan, 43, of Mississauga, said he's
sponsored 100 family members and other Iraqi Christians to
Canada since arriving in 1989. 'I am grateful that at one time
someone helped me,' said Sepan. 'No one I ever sponsored has
ended up on welfare.'

Amnesty International today called on all states to eradicate
the
scourge of torture and all other forms of cruel, inhuman or
degrading
treatment or punishment. The call came as the world prepared to
mark
the 20th anniversary, on 26 June 2007, of the entry into force
of the
UN Convention against Torture and Other Cruel, Inhuman or
Degrading
Treatment or Punishment, adopted in 1984 for signature and
ratification after long campaigning by Amnesty International
and other
organizations.
On the eve of that anniversary, a substantial majority of the
world's
states -- 144 in all regions -- will have ratified the
Convention and
a further eight states will have signed it. Its adoption has
contributed to regional treaties prohibiting torture and
torture has
been included as a war crime and a crime against humanity in
the Rome
Statute of the International Criminal Court. The Committee
against
Torture regularly reviews reports of states parties on the
implementation of the Convention, making findings and
recommendations
to states on how to prevent and punish torture and provide
reparations
to victims. The Committee also examines individual complaints
by
victims alleging torture. The UN has appointed a Special
Rapporteur on
torture to address reports of torture and recommend actions by
all
states, whether they are parties to the Convention or not.
The Convention has a number of important features. It defines
torture
(Article 1) as both a human rights violation and a crime,
involving
the intentional infliction of severe pain or suffering for
purposes
such as punishment, intimidation and the obtaining of
information,
when done by officials, at their instigation or with their
consent or
acquiescence.
It requires each state party to "take effective legislative,
administrative, judicial or other measures to prevent torture,"
makes
clear that "o exceptional circumstances whatsoever" justify
torture
and rules out any defence of superior orders (Article 2).
Article 3
prohibits the transfer (refoulement) of anyone to a place where
he or
she risks torture and Article 4 requires that all acts of
torture be
defined as a crime. States must investigate when anyone
suspected of
torture is found on their territory (Article 6), must provide
for
universal jurisdiction over such persons (Article 5 (2)) and,
if such
suspects are not extradited, submit the case to their
prosecutors
(Article 7 (1)). They must investigate promptly and impartially
whenever there are reasonable grounds to believe that an act of
torture has occurred in territory subject to their jurisdiction
or
such an act is alleged (Articles 12 and 13). States must train
all law
enforcement personnel not to torture (Article 10), provide
reparations
to victims (Article 14) and exclude any statement made as the
result
of torture in any proceeding, except to prove that torture
occurred
(Article 15). The Convention also requires states to take
measures
against other cruel, inhuman or degrading treatment or
punishment
(Article 16).
Last year saw a further major development towards greater
protection
against torture and other ill-treatment. On 22 June 2006, the
Optional
Protocol to the Convention, which had been adopted on 18
December
2002, entered into force. To date, 56 States have signed the
Protocol,
and 34 have ratified or acceded to it. The Protocol mandates
independent international experts to conduct regular visits to
places
of detention within states parties, and requires states parties
to set
up national mechanism to conduct visits to places of detention
and to
cooperate with the international experts.
However the Convention, and the struggle to rid the world of
torture
and other ill-treatment in general, continue to face serious
challenges.
These challenges include, first and foremost, the continued
infliction, in many countries, of torture and other
ill-treatment on
detainees, prisoners and others. In police stations, prisons,
military
detention facilities, interrogation centres and other locations
all
around the world officials abuse the absolute power they have
over
defenceless persons deprived of their liberty and inflict pain
on
them, or else they allow others to inflict such pain with
impunity.
Amnesty International's annual reports depressingly show, year
after
year, that the majority of states in the world still torture or
ill-treat persons under their control. Of the 153 states and
territories surveyed in the organization's 2007 annual report,
at
least 102 had resorted to torture or other ill-treatment.
Another challenge is the attempts by some to challenge the
absolute
prohibition on torture and other ill-treatment, for instance by
arguing that they are essential weapons in the "war on terror."
Facing an outcry against such a call for states to adopt
criminal
conduct as official policy, certain governments have resorted,
instead, to playing word-games, making definitional and
interpretational manoeuvres including by:
claiming that certain methods of interrogation or forms of
punishment
do not constitute torture;
claiming that the prohibition on cruel, inhuman or degrading
treatment
or punishment is not quite as absolute as that on torture, and
therefore states may ill-treat prisoners in certain
circumstances;
"subcontracting" torture to other states and claiming that
responsibility rests solely with them;
circumventing non-refoulement obligations through devices such
as
diplomatic assurances.
Why is the eradication of torture and ill-treatment proving so
elusive? Reasons include lack of political will and failure to
enact
effective implementing legislation, to provide training, to
investigate or prosecute, extradite and to establish effective
procedures for victims to obtain reparations no matter who
committed
them and no matter where the torture occurred.
What must be done? States must take their international
obligations
seriously. Those which have not ratified the Convention must do
so.
Those which have attached reservations weakening the
Convention's
protections must withdraw them. Those which have not allowed
individual complaints to be considered by the Committee against
Torture must now allow such complaints. Those which have not
ratified
the Optional Protocol must do so. States must also contribute
generously to the United Nations Voluntary Fund for Victims of
Torture.
States parties should also nominate and vote for independent
candidates of the highest calibre in elections to the Committee
against Torture which will take place on 8 October 2007.
Candidates
should possess a broad experience relevant to the Convention,
an
in-depth understanding of issues relevant to the deprivation of
liberty and a long-standing commitment to human rights.
Candidates
should not hold a position in the executive or legislative
branch of
government. In order to improve the selection of candidates,
states
should put in place a process at the national level which is
consultative, transparent and well-publicized. Amnesty
International
urges states parties to ensure that considerations of quality
prevail
over those of politics in the forthcoming elections.
At the national level, states must amend flawed implementing
legislation and enact effective implementing legislation where
none
exists, provide training, establish special units of police and
prosecutors to investigate reports of torture and to prosecute
suspects, including on the basis of universal jurisdiction, or
extradite them to states able to do so in fair trials without
the
death penalty or the risk of torture or ill-treatment. Indeed,
they
must never transfer anyone to any place where they would be at
risk of
torture or ill-treatment. They must establish independent,
professional and adequately resourced national visiting
mechanisms in
accordance with the provisions of the Optional Protocol.
A positive example of action at the national level is the
appeal
launched today by Redress in the Parliament in London to enact
the
Torture (Damages) Bill, introduced in the House of Lords on 5th
March
2007 [HL Bill 49]. This bill, strongly supported by Amnesty
International, would provide effective procedures for
fulfilling the
United Kingdom's obligations under Article 14 of the Convention
against Torture by permitting any victim of torture to obtain
reparation in civil proceedings even when committed abroad.
Torturers must not be allowed to get away with their crimes --
be they
perpetrators, their civilian superiors or military commanders
or the
state as a whole. Victims must not be left to suffer -- their
torture
must be stopped, their torturers punished, and their right to
reparation ensured.
