As of Jan. 31, Canadian citizens are no longer able to simply declare their citizenship at the border when seeking to enter the U.S. Now they must be prepared to produce documents proving their citizenship and their identity. (For what it's worth, the same rules apply to U.S. citizens who are seeking to re-enter their home country.) The confusion is on two fronts. First, there is conflicting information about whether the new rules are being enforced. The word from senior U.S. officials is that, for an unspecified time, border officers have been given discretion to warn travellers who show up without the proper identification documents. (The same sort of discretion was applied when new rules required people entering the U.S. by air to travel with a passport). In this case, border officials will be keeping track of the people who have been issued a warning and are unlikely to let them through a second time without proper identification. There has also been some confusion about what these rule changes mean for non-Canadians who are resident in Canada. In fact, these changes have nothing to do with them. Non-Canadians who reside in Canada and seek to cross the border are still required to produce a valid passport as their travel document and to obtain a visitor visa, unless they come from a country that is on the U.S. visa waiver list. For Canadian citizens, single documents that can serve to prove both citizenship and identity include a Canadian passport, a NEXUS, SENTRI or FAST trusted traveller card, an Indian and Northern Affairs Canada (INAC) card or an enhanced driver's licence (when they become available). Canadians who are older than 18 and don't have any of these will have to show two documents, one to prove identity and the other to prove citizenship. Eligible documents to prove identity include: A provincial or territorial driver's licence with a photo ID.. A photo ID card issued by a federal, territorial, provincial or municipal authority. A military identification card. The following documents can be used to establish Canadian citizenship: A Canadian birth certificate. A Canadian citizenship card. A Canadian certificate of citizenship without a photo. Finally, Canadian citizens who are 18 and under don't have to produce two documents. They can enter the U.S. with a valid birth certificate. The U.S. government's rationale for the policy change is that too many people were managing to enter the U.S. by making false declarations of Canadian or U.S. citizenship. Officials also argue the new rules will help border officers by standardizing the list of acceptable documents. Feb. 4 2008 9:39 PM ET CTV.ca News Staff TORONTO -- U.S. forces shot Omar Khadr twice in the back before the young Canadian terror suspect allegedly killed one of their commandos during a 2002 firefight in Afghanistan, according to one witness. The unidentified U.S. fighter said Khadr was hit by shrapnel and was facing away from the firefight when he was shot inside an al Qaeda compound. The statement came on a day Khadr's lawyers were pushing to have all the charges against him dropped. The legal representatives of the Canadian being held in Cuba's Guantanamo Bay appeared at the military tribunal on Monday. They argued for the dismissal of the charges based on the following criteria: The fact that the tribunal itself was not established until after the alleged crimes occurred. Their belief that the crimes occurred during a legitimate military exchange. Khadr, now 21, was 15 when he was captured by U.S. forces in July 2002 while fighting against the Americans in Afghanistan. He stands accused of lobbing a grenade that killed a U.S. Special Forces commando. The tribunal heard arguments Monday on whether it has the right to try Khadr for his alleged crimes. He is accused of murder, conspiracy and providing material support to terrorism, and could face up to life in prison if convicted. The eyewitness also said a second enemy fighter was alive inside the compound when he entered. Khadr's defence lawyers said this casts doubt on the U.S. government's conclusion that Khadr threw the grenade. "It does raise questions as to basic facts of the government's case," said Khadr's lead defence lawyer, U.S. Navy Lt.-Cmdr. William Kuebler. The judge, army Col. Peter Brownback, did not immediately issue a ruling. Khadr was not shackled during his appearance Monday. He wore a white prison jumpsuit and had a short trimmed beard, and kept his eyes on the floor during much of the appearance, The Associated Press reports. The tribunal heard from Rebecca Snyder, one of Khadr's defence lawyers, that Khadr can't be tried for murder as a war crime because the offence occurred during a battle and should be classified under traditional laws of war. "Soldiers are not protected targets," she argued. "That is part of what war is about, killing soldiers." Earlier Monday, Khadr's Canadian lawyer Dennis Edney told CTV's Canada AM the defence had a number of concerns. "We have a number of motions before the judge," lawyer Edney said. "One, of course, is that Omar Khadr be designated a child soldier. The other is we're challenging the definition of terrorism, particularly Omar Khadr being detained as a terrorist on a tobacco field. Essentially, we're challenging all the various indictments against Mr. Khadr." The lead prosecutor in the tribunal, Marine Corps Maj. Jeffrey Groharing, said Khadr wasn't following accepted ruled of legitimate warfare and therefore should be tried by the special court. He pointed out that Khadr conducted surveillance in civilian clothing, and lived with women and children at a compound where the fighting took place. "The accused and the terrorists he was working with did not belong to a legitimate army, they belonged to al Qaeda,'' Groharing said. Col. Peter Brownback, who is presiding over the hearing, did not immediately issue a ruling. Edney said Monday's court proceedings in Cuba are an "extremely meaningful" part of the trial process, but he questioned whether the outcome would be favourable towards his client. He said the Canadian government has let his client down, and must share in taking responsibility for his current plight. "The Canadian government stands out amongst most other civilized countries throughout the world. It has not only failed to criticize Guantanamo Bay as a blight on the rule of law, it has not said a single word on behalf of Omar Khadr," Edney said. "And that stands in contrast to the language it uses when criticizing the Chinese government's human rights record. So Canada will not say a single word of criticism about Omar Khadr to the Americans, and by not doing so, one then would suggest Canada is implicated with the Americans on their view of the law and the on war on terrorism." Amir Attaran, a law professor at the University of Ottawa, called the tribunal a "kangaroo court" "He was a child soldier and there has not been in the Western world a prosecution against a child soldier since the 18th century. So this is something really quite perverse that the United States court is doing, and that's the point of his lawyers, it should be thrown out of the court, done with," Attaran told Canada AM. Edney said his first challenge was just to meet with his client. He spent much of yesterday waiting to meet with him, but was eventually denied the opportunity "because of security and various other strange reasons." He said it was difficult to discuss their strategy because security restrictions prohibit Khadr from seeing all the evidence against him. Kuebler told The Associated Press that the trial, if it proceeds, could set a dangerous precedent. "The best case scenario is the judge does the right thing and dismisses the charges on the grounds that Congress did not intend this system to apply to a minor,'' Kuebler said. He said the judge would be the first in western history to preside over a trial for alleged war crimes committed by a child. The U.S. Defence Department maintains that the tribunal system established by the Bush administration in 2006 is the most appropriate venue to prosecute Khadr. He has been described as an "enemy combatant" by the U.S. Khadr is accused in court documents of travelling through Afghanistan and Pakistan with his father from the time he was 10 years old. Speaking at a hearing at the U.S. naval base in Guantanamo Bay, Cuba, the Toronto-born Khadr's lawyers sought dismissal of the charges on several grounds. Among other things, the lawyers say the tribunal itself was not formed until after the alleged crimes occurred. They also say that the crimes for which Mr. Khadr is charged occurred during a legitimate military contest. Mr. Khadr is alleged to have hurled a grenade that killed U.S. army Sgt. 1st Class Christopher Speer, a Special Forces commando, during a firefight at an al-Qaeda compound in Afghanistan in July 2002. The Toronto-born Khadr was 15 years old at the time. He faces possible life in prison if convicted of murder, conspiracy and providing material support to terrorism. Mr. Khadr, now 21, had a short-trimmed beard and stared at the floor during long stretches of the arguments. He was not shackled and wore a white prison jumpsuit reserved for the most compliant detainees. Defence lawyer Rebecca Snyder told the tribunal that Mr. Khadr is not eligible to be tried for murder as a war crime because the alleged offence occurred during a firefight under traditional laws of war. Soldiers are not protected targets, she argued. That is part of what war is about, killing soldiers. Earlier filings in support of Mr. Khadr argued that he was ineligible for prosecution under internationally accepted rules protecting child soldiers. The lead prosecutor, Marine Corps Maj. Jeffrey Groharing, said Mr. Khadr should be prosecuted at the special court because he conducted surveillance in civilian clothing and lived with women and children at a compound where the firefight occurred. The accused and the terrorists he was working with did not belong to a legitimate army, they belonged to al-Qaeda, he said. The judge, army Col. Peter Brownback, did not immediately issue a ruling. Defence lawyers also argued the law authorizing U.S. military tribunals should not apply to Mr. Khadr because the alleged offences occurred before the court was created under 2006 after the U.S. Supreme Court threw out the rules for a previous court system. Prosecutors, however, said Congress clearly meant for the tribunals to prosecute terrorism suspects who were involved in or supported the Sept. 11, 2001, attacks. From the time he was about 10 years old, Mr. Khadr travelled through Afghanistan and Pakistan with his father, an alleged al-Qaeda financier, and visited terrorist leaders including Osama bin Laden, according to court documents. After his arrest, he acknowledged seeking to kill Americans because he was told the U.S. opposed Islam, military prosecutors say. The trial scheduled for May is on track to be one of the first for a detainee at this U.S. naval base in southeast Cuba, where the Pentagon's efforts to hold the first U.S. war-crimes trials since the Second World War era have been stalled by legal setbacks. [5]sos dfait legal mail [cdn in nm, usa] Posted by: "dfait_sos" [6]no_reply at yahoogroups.ca [7]dfait_sos Thu Feb 21, 2008 4:34 pm (EST) dated: 02/10/08 postmarked: 13 feb 2008 rec'd & posted: feb 22, 2008 dear aicap, hey there! i've had your address for like two years, and meant to write a long time ago, but for some reason never did. it probably had alot to do with my just-failed attempt to get my sentence transferred to canada under the bilateral transfer of offenders treaty. i spent 2 1/2 years going through the application process, invested alot of hope into it, got approved every step of the way - canada corrections, solicitor general, u.s. dept. of justice, and the application was finally denied by the governor's office (bill richardson). in any case, i was pretty crushed & probably figured there was no use at that point even to contact you. ironically, i'm now hearing that since bill richardson's failed presidential run, the state is now interested in getting rid of me, but now the consulate tells me steven harper's government is denying almost everybody, and as a sex offender, my chances of getting approved again are almost nil. sigh...but perhaps it's for the best. i'm at the halfway mark of my nm sentence, and if i do my time here, when i get extradited back to canada (fall 2014) i will have no record, no parole. transferring my sentence would mean a probable earlier release, but also a decade of parole time. anyway, i don't want to write too long a ltter, as i don't even know if your organization is still in existence, so a brief history: i'm a native montrealer, born & raised, but lived a decade in vancouver, which i consider my second home. in 1992/93 i came to new mexico for an extended stay (about 6 months - fall '92 - through spring '93) which straddled my 18th birthday. throughout that time i became involved in a ridiculously foolish sexual relationship with a minor many years my junior. it was consensual, but morally and undeniably wrong on my part. it was a manifestation of regularly self- destructive behaviour on my part at the time. i had come to new mexico to try and escape a heroin addiction. i soon returned to montreal & continued with my addiction through years & into vancouver. eventually i got (semi) clean, went back to school and started to repair my life. then, in the summer of 2000 my house was raided by the vancouver police on unrelated charges. upon seizing my computer, police found thousands of pages of chat-room transcripts, which (again, foolishly) contained descriptions of the illicit affair here in new mexico years earlier. the vancouver police forwarded the transcripts to the new attorney general, who filed charges. i was living in amsterdam by that time with a longtime boyfriend. i was arrested on a trip to san diego in fall 2001 and extradited to new mexico, where i found to my horror i was facing a possible 250 years in prison. every count of oral sex performed on the minor was an 18-24 year sentence. i was charged with 7 counts of that alone, along with a slew of ridiculous other charges. i spent 2 years in solitary protective custody - no tv, no radio, very few books, after watching virtually all of the convictions on the flimsiest of evidence, often getting hundreds of years in prison, i realized my only hope for eventual freedom was to take the best plea i could get. i had no idea if they'd contacted the minor involved (now a grown man) on whether he'd testify against me or what. anyway, the best deal i could get was a 54 year sentence with a 24 year cap (30 year suspended). as i know i'd be deported immediately upon release, i knew that suspended 30 years could never come back to haunt me in a parole or probation violation. the laws of sentencing back in '93 allowed for 50% good-time, so in the end i'd end up doing about 13 years (2 years in county jail was "flat" time). so, i'm hoping to return to canadain november 2014 - about 6 1/2 years. i still have charges to face in vancouver, and expect to serve maybe a year or so (or maybe not). well, that's the reader's digest version of my story. i look forward to hearing from you and finding out what you do. trevor v. duncan #59496 6900 w. millen drive hobbs, new mexico 88244, usa ============================================================= [8]Back to top [9]Reply to sender | [10]Reply to group | [11]Reply via web post [12]Messages in this topic (1) Recent Activity * 1 [13]New Members * 1 [14]New Files [15]Visit Your Group Yahoo! 360 Canada [16]Create your place.
