The stay of execution for Mark Schwab has been lifted.  After 18 months 
without an execution, the State of Florida is about to re-start the 
killing of captive prisoners.

Death Warrants do not expire.  It is not necessary for the governor to 
sign a new warrant for this execution, just set a date and leave it up 
to the D.O.C. to carry out the killing in the name of the "People of 
the State of Florida."

More and more Floridians are speaking up and demanding a better way to 
help the victims of violent crime and their families...a better way to 
protect the people of Florida...a better way to a safer, more humane 
and less violent Florida.

Supreme Court rejects Schwab appeal

A new date for Mark Dean Schwab's execution will soon be set.

The U.S. Supreme Court this morning lifted a stay that blocked Schwab's 
execution in November. Schwab faces the death penalty for the 1991 
torture, rape and murder of 11-year-old Junny Rios-Martinez.

Florida Attorney General Bill McCollum asked the high court in April to 
lift the stay after justices ruled in a Kentucky case that upheld the 
constitutionality of lethal injection.

"He has an active warrant and we await word from the governor's office 
concerning setting a date," said Joellyn Rackleff, a spokeswoman for 
the Department of Corrections.

In April, Gov. Charlie Crist said "justice is waiting" after the U.S. 
Supreme Court ruling that put Florida back on a path to carry out death 
sentences again after an 18-month hiatus in Florida.

A spokesman for Crist said the governor's office would have more detail 
about what's next later today.

Schwab has an outstanding motion for rehearing with the Florida Supreme 
Court.

But Assistant State Attorney Wayne Holmes said in April it is basically 
a matter of paperwork before they are resolved.

"Realistically, we could see his execution by June," Holmes said last 
month. "All of the issues have clearly been removed."
